Terms of Service

1. Overview

www.bringyournutrition.com (the "Site") is operated by BYN LLC, a Delaware limited liability company ("BYN," "we," "us," or "our"). These Terms of Service ("Terms") apply to everyone who visits the Site, creates an account, buys from us, or uses our services, including our email, SMS, and early access programs (together, the "Service").

By using the Service or placing an order, you agree to these Terms and to the policies they reference, including our Privacy Policy, Shipping Policy, Return & Refund Policy, Pricing Policy, and Limited Warranty. If you do not agree, do not use the Service.

Section 18 contains a binding arbitration agreement and class action waiver. It affects how disputes are resolved. You may opt out within 30 days, as described there.

We may update these Terms by posting a new version on this page. Changes apply from the date posted. Continuing to use the Service after a change means you accept it. Changes do not apply to an order placed before the change was posted.

Our store runs on Shopify. Purchases made on Amazon, TikTok Shop, or other marketplaces are also governed by that marketplace's terms.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to use the Service or buy from us. You may check out as a guest. If you create an account, you agree to give accurate information, keep it current, and keep your login secure. You are responsible for activity under your account.

3. Use of the Service

You may not use the Service for any unlawful purpose or in violation of these Terms. You may not transmit viruses or other harmful code. You may not copy, sell, resell, or exploit any part of the Service without our written permission. Breaking any of these rules may result in immediate termination of your access.

4. Products

We describe products, colors, sizes, and capacities as accurately as we can. Colors may look different on your screen than in person. Product images may include props or food that are not included.

On our Site, BYN containers are sold in sets and bundles. Pack sizes and availability may differ on Amazon and other marketplaces.

You agree to use our products according to the Care & Use guide, including the stated temperature limits. Misuse can damage the product or cause injury, and is not covered by our Limited Warranty.

We may limit quantities, refuse sales to resellers or distributors, and discontinue any product at any time.

5. Pricing, promotions, and payment

Prices are in U.S. dollars and are set out in our Pricing Policy. Promotion codes are subject to the terms stated with the offer and in the Pricing Policy. Sales tax is added where required.

You agree to give current, complete, and accurate payment and billing information. You authorize us and our payment processors to charge your payment method for your order, including taxes and shipping.

6. Orders

Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, including after you receive a confirmation email. Reasons include limited stock, errors in pricing or product information, or suspected fraud. If we cancel an order after charging you, we will refund the charge in full.

7. Shipping, title, and risk of loss

We ship to addresses in the contiguous United States only. Delivery estimates are estimates, not guarantees, except where a written guarantee is stated, such as the November ship-date guarantee in our Early Access & Pre-Order Policy. Title and risk of loss pass to you when the carrier delivers your order to your shipping address. See our Shipping Policy.

8. Returns, refunds, and warranty

Returns and refunds are governed by our Return & Refund Policy. Product defects are covered by our Limited Warranty.

9. Errors and inaccuracies

The Site may contain typos, inaccuracies, or omissions in descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct them, change information, or cancel affected orders at any time without prior notice, including after you submit your order.

10. Accuracy and timeliness of information

Site content is for general information and may not always be current or complete. We have no obligation to update it, except as required by law.

11. Changes to the Service and prices

We may change or discontinue the Service, products, or prices at any time without notice. We are not liable to you or anyone else for any change, suspension, or discontinuance.

12. Third-party tools and links

The Service may include tools, content, or links from third parties, such as payment processors, review platforms, shipping carriers, and social media. We do not control third-party sites or services. We provide them "as is," without warranty, and are not responsible for them. Your use of them is at your own risk and under their terms.

13. Reviews, comments, and submissions

If you send us reviews, photos, videos, comments, ideas, or other content ("Submissions"), you grant BYN a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, edit, publish, and display them in any media, including in advertising, with your first name or handle. We have no obligation to keep Submissions confidential, pay for them, or respond to them.

You confirm that your Submissions are your own, are truthful, and do not violate anyone's rights or any law. Reviews must reflect your genuine experience. We may remove Submissions we find unlawful, offensive, or otherwise objectionable. Creators and affiliates are also governed by our Affiliate & Creator Program Terms.

14. Personal information

Our Privacy Policy governs how we collect and use personal information.

15. Prohibited uses

You may not use the Service to:

break any law or regulation;
infringe our intellectual property or anyone else's;
harass, abuse, defame, or discriminate against anyone;
submit false or misleading information, including fraudulent orders or chargebacks;
upload or transmit viruses or other malicious code;
collect other people's personal information;
scrape, crawl, or spider the Site, or use bots to buy products;
interfere with or circumvent the Site's security features;
buy products for resale without our written permission.

16. Disclaimer of warranties; limitation of liability

Except as stated in our Limited Warranty and to the extent permitted by law, the Service and all products are provided "as is" and "as available." To the extent permitted by law, we disclaim all other express or implied warranties. Any implied warranties that cannot be disclaimed are limited to the duration of our Limited Warranty.

To the fullest extent permitted by law, BYN and its members, managers, employees, affiliates, agents, suppliers, and service providers are not liable for any indirect, incidental, punitive, special, or consequential damages, including lost profits, lost data, or replacement costs, arising from your use of the Service or any product. Our total liability for any claim relating to a product is limited to the price you paid for it.

Some states do not allow these exclusions or limits. In those states, our liability is limited to the fullest extent the law allows. Nothing in these Terms limits liability that cannot be limited by law, including for personal injury caused by our negligence.

17. Indemnification

You agree to indemnify and hold harmless BYN and its members, managers, employees, affiliates, agents, and service providers from any third-party claim, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

18. Dispute resolution: binding arbitration and class action waiver

Informal resolution first. Before starting arbitration or a small claims case, you agree to email support@bringyournutrition.com with your name, order number (if any), a description of the dispute, and the relief you want. We will do the same with the contact information we have for you. Both sides will try in good faith to resolve the dispute within 60 days.

Agreement to arbitrate. If the dispute isn't resolved informally, you and BYN agree that any dispute arising from or relating to these Terms, the Service, any product, or any marketing communication will be resolved by binding, final, and confidential arbitration before a single arbitrator, and not in court. The American Arbitration Association ("AAA") will administer the arbitration under its Consumer Arbitration Rules. The arbitrator decides all questions about the scope and enforceability of this agreement. Arbitration may be held by video, by phone, by written submissions, or in the county where you live. We will pay AAA filing and arbitrator fees above the amount you would pay to file in court, unless the arbitrator finds your claim frivolous.

Exceptions. Either party may bring an individual claim in small claims court. Either party may seek an injunction in court to stop infringement or misuse of its intellectual property. Claims for public injunctive relief that cannot be waived under applicable law may proceed in court after the individual arbitration ends.

Class action waiver. You and BYN may bring claims only on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not combine more than one person's claims. If this waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration.

Mass filings. If 25 or more similar arbitration demands are filed against BYN by or with the help of the same law firm or organization, they may be administered in batches under the AAA's mass arbitration supplementary rules.

30-day opt-out. You may opt out of this arbitration agreement within 30 days of your first purchase or account creation, whichever comes first. Email support@bringyournutrition.com with the subject line "Arbitration Opt-Out" and include your name, email, and shipping address. Opting out does not affect any other part of these Terms.

Survival. This Section survives termination of these Terms.

19. Governing law and venue

These Terms are governed by the Federal Arbitration Act and, otherwise, by the laws of the State of Delaware, without regard to conflict-of-law rules. Any claim not subject to arbitration will be brought in the state or federal courts located in Delaware, unless it is a small claims case in the county where you live.

20. Severability and waiver

If any part of these Terms is found unenforceable, it will be limited to the minimum extent necessary, and the rest remains in effect. Our failure to enforce any right is not a waiver of it.

21. Termination

These Terms apply until terminated by you or us. You may stop using the Service at any time. We may suspend or end your access without notice if we believe you have broken these Terms. Obligations incurred before termination, including payment, and Sections 13 and 16–20 survive.

22. Entire agreement

These Terms and the policies they reference are the entire agreement between you and BYN about the Service and replace any earlier agreements. Any ambiguity will not be construed against the drafter.
