Affiliate & Creator Program Terms

BYN runs two creator programs. In the Affiliate Program, you earn commission on sales from your own posts through your affiliate link or code. In the Creator Ads Program, you earn commission on sales from BYN's paid ads that use your content.

These terms are an agreement between you and BYN LLC ("BYN"). By joining either program (each a "Program") through the platform we use to run it, you agree to them. Sections 2–4 and 7–13 apply to both Programs.

1. The two Programs

"Affiliate platform" and "creator ads platform" mean the third-party services BYN uses to run each Program. We may change platforms; if we do, we will tell you how to move over.

2. Eligibility

You must be at least 18 years old and live in the United States. You may join one or both Programs. We may approve or decline any application and remove anyone from either Program at any time.

3. Commission

Net sales means the product price the customer paid, after discounts, excluding taxes, shipping, and gift cards, less any returns, refunds, cancellations, and chargebacks.

Affiliate Program

• Qualifying orders: Orders placed on bringyournutrition.com through your unique link or code within 7 days of the click. When more than one affiliate referred an order, the last valid link or code used gets the credit.
• Not eligible: Your own purchases, and orders on Amazon, TikTok Shop, or other marketplaces.

Creator Ads Program

• Qualifying sales: Sales that the creator ads platform attributes to a BYN ad using your content, under the attribution method shown in that platform.
• No guaranteed spend: BYN decides whether, where, when, and how long to run ads, and how much to spend. We don't guarantee any ad spend, sales, or commission.

Both Programs

• One commission per order: If an order qualifies under both Programs, we pay one commission on it, at the higher of the two rates.
• Tracking: Each platform's records decide commissions under its Program. We are not responsible for sales that aren't tracked because of cookie or ad blocking, browser settings, or a customer not using your link or code.

4. Payment

Approved commissions are paid through each Program's platform on the schedule in Section 1. A commission is approved after the order's 30-day return window closes. You must give each platform valid payment and tax information, including a Form W-9. You are responsible for your own taxes. If an order is refunded after you are paid, we may deduct that commission from future payments.

5. Your affiliate link and code (Affiliate Program)

• Use only the links and codes the affiliate platform gives you, and don't change them.
• Don't hide where your link goes, for example with cloaking or redirects that conceal that it leads to BYN.
• Don't fake clicks, set tracking cookies for people who didn't click your link ("cookie stuffing"), or pay or reward people to click or buy.
• Don't run your link or code in paid ads unless we approve it in writing. Paid promotion of BYN goes through the Creator Ads Program.
• Don't use your own link or code for your own purchases.
• We may turn off any link or code at any time. Commissions earned by breaking this section are not paid.

6. Creator ads (Creator Ads Program)

• Content: You deliver the content agreed in the creator ads platform, such as the brief, format, and deadline.
• Editing: We may trim, caption, resize, and combine your content with other material to make ads. We won't edit it to make you appear to say something you didn't say.
• Running ads from your account: If you authorize us to run ads from your account (for example, Spark Ads or partnership ads), we will use that access only for BYN ads, for the period you authorize. You can revoke it in the platform at any time. Revoking stops new ads from your account but doesn't end the content license in Section 10.
• Ad labels: Our ads using your content will carry each ad platform's paid partnership or sponsored label where one exists.

7. FTC disclosure

You must clearly disclose your relationship with BYN in every post, video, or story that mentions BYN, as the FTC's Endorsement Guides require. Use plain words like "#ad," "#BYNpartner," or "I earn commission from BYN," placed where people will see them before clicking or buying. On video, say it out loud too. Use each platform's paid partnership label where it has one. Disclosure only in a bio, at the end of a caption, or hidden among other hashtags doesn't count.

8. Product claims

This section applies to your posts and to any content you make for our ads. You may describe BYN only as our website describes it. You may share your honest personal experience with the product.

You may not:

• make broad or absolute claims, such as "100% safe," "totally non-toxic," "the safest," "chemical-free," or "lasts forever";
• make health, medical, weight-loss, or nutrition claims;
• make claims about PFAS, "forever chemicals," or test results beyond the exact wording on our Materials & Safety page;
• state temperature, microwave, oven, freezer, or dishwasher uses beyond our Care & Use page;
• compare BYN to other brands in a way that is false or that you can't support;
• make up reviews or pretend not to be affiliated with BYN.

If we ask you to correct or remove content, you must do so within 48 hours. We may decline to use any content that doesn't meet this section.

9. Prohibited promotion

• Bidding on "BYN," "Bring Your Nutrition," or similar terms in paid search ads
• Posting codes on coupon, deal, or cashback sites without our written approval
• Spam, unsolicited texts or emails, or buying followers or engagement
• Using our logos or product photos except in materials we provide
• Content that is unlawful, hateful, sexually explicit, violent, or otherwise harmful, or that infringes anyone's rights
• Creating social accounts, websites, or domains that use BYN's name or could be mistaken for BYN

10. Content license

You keep ownership of the content you create about BYN ("Creator Content"). You grant BYN a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, copy, edit, adapt, publish, and distribute Creator Content in any media now known or later developed, including:

• on our website, emails, social accounts, packaging, and marketplaces;
• as paid advertising, including from your account for the period you authorize under Section 6; and
• with your name, handle, likeness, voice, and biographical information as they appear in the content.

You confirm that you own or have the rights to everything in your Creator Content, including music and the likeness of anyone who appears in it, and that BYN owes no one any payment for its use. No additional payment is owed to you for BYN's use of Creator Content beyond the commissions in Section 3, unless we agree otherwise in writing.

11. Relationship

You are an independent contractor, not an employee, partner, or agent of BYN. You may not make commitments on BYN's behalf.

12. Ending participation

Either you or BYN may end your participation in either Program at any time. If you break these terms, we may withhold unpaid commissions on the affected orders. Sections 4 (refund deductions), 8, 10, and 13 survive after you leave a Program.

13. Other terms

We may change these terms by emailing you or posting the update in the relevant platform. Continuing in a Program after a change means you accept it. To the extent permitted by law, BYN's total liability to you under the Programs is limited to the commissions you earned in the 6 months before the claim. The dispute resolution terms and Delaware governing law in our Terms of Service apply.
